E-Waste Management Rules in India

According to the E-Waste (Management) Rules, 2016, which went into effect on October 1, 2016, State Pollution Control Board approval is required for units that are dismantled and recycled. The Ministry of Electronics and Information Technology supports CPCB guidelines and SPCB oversight that aims to modernize the recycling sector.

The 2016 guidelines are replaced by the E-Waste (Management) guidelines, 2022, which go into effect on April 1, 2023. Under the new Extended Producer Responsibility (EPR) regulations, producers, refurbishes, dismantlers, and recyclers must register via a site created by the CPCB. It is forbidden for unregistered businesses to conduct business.

Under the EPR system, 106 items of Electronic and Electrical Equipment (EEE) are covered. Producers must meet yearly recycling goals that increase from 60% in 2023–2024 to 80% in 2027–2028. Since the regulations now cover solar PV modules, panels, and cells, the amount of recycled material is calculated based on the final products. The creation of EPR certificates and the inclusion of clauses pertaining to environmental compensation, auditing and verification, and steering committees are presented.

The E-Waste Management Rules place a strong emphasis on limiting lead, mercury, and other hazardous materials in the manufacturing of EEE.
